Before: ENGEL, KEITH and MERRITT, Circuit Judges Order Plaintiff is appealing from a judgment dismissing his action alleging racial discrimination under 42 U.S.C. § 1983. On January 23, 1981, he filed a motion for appointment of counsel on appeal. Upon consideration of the record, it appeared that the notice of appeal had not been timely filed. However, it further appeared that a motion for leave to file a late notice of appeal was then pending in the district court. Accordingly, an order was entered remanding the case to the district court for a ruling upon plaintiff's pending motion. The order further directed that the motion for appointment of counsel be held in abeyance pending a decision by the district court.
